RENTAL AGREEMENT
COMPANY herein after called "renter" hereby rents vehicle to customer subject to all terms and conditions on this agreement as well as those included on the front side there of agrees in their entirely.
DELIVERY AND RETURN
The vehicle is delivered to the renter in good condition and without apparent defects. The renter agree to return it with all accessories, tools and in the same condition he received it, full of fuel and at the location and on the date designated in this agreement.
CONDITION OF USE
The renter is expected to look after the vehicle, to check its mechanical condition, the oil and water level, the tyres etc. and generally to behave in a prudent manner. Any repair of vehicle by renter or any other person without permission is not allowed. Vehicle must not be used : a) to carry persons or property for hire, b) to tow any vehicle, to trailer or other object c) to participate or to follow Rallies d) where renter or any authorized drivers is under influence of alcohol, medication, drug etc. e) in contravention of any customs, traffic or other regulations f) by any third person other than renter and any additional driver for purpose contrary to the Greek Low.
ACCIDENTS
In case of an accident or any other incident (fire, theft e.t.c.) renter or the additional driver are obliged to immediately do the following: a) Note the names and the addresses of eye witnesses and also the name and the addresses of the driver and the data of the vehicle, with which vehicle may have collided b) Do not acknowledge third party claims direct or indirect c) complete an sing an accident report d) call the Police e) contact COMPANY immediately.
INSURANCES
COMPANY provides renter and any additional driver with insurance coverage by insurance companies of its choice for death or injuries of third parties, for material damages of third parties caused on object inside or on vehicle. Luggage insurance is not available and renter is responsible for any loss of property belonging to the passengers. Any insurance for damaged tyres or any damage to the underneath of the vehicle is not available.
THEFT, DAMAGE E.T.C
a) Renter is responsible for all the damages he has caused to others, in case he has violated the terms of use of vehicle or in case he has been driving same in an illegal manner or in violation of the Greek Traffic Low.
b) Renter is responsible for partial or total theft of loss of vehicle unless COMPANY release renter from the responsibility for total theft or loss of vehicle such release is valid provided that renter has already accepted at the beginning of rental the daily charge and the condition of "Theft Protection" (T.P.C) of vehicle and Collision Damage Waiver (C.D.W) as these terms are defined in official price list, by initialling the " Accepts" box in front side of this agreement, provide that renter has taken all the precautions to avoid total theft or loss of the vehicle and has used it in compliance with the terms of this agreement. It is expressly agreed that theft or loss of parts, accessories, and equipment (partial theft) of vehicle is not covered by acceptance of" Theft Protection" and "Collision Damage Waiver".
c) Renter is responsible for every damage or loss of vehicle due to collision or fire, unless renter has accepted the term "Collision Damage Waiver" (C.D.W) by initialling in the "Accept" box on the front side of this agreement and by paying their respective daily charge. The acceptance of the Collision Damage Waiver ( C.D.W) does not release renter if vehicle was not used in compliance with the terms of this agreement.
CHARGES
a) The renter pays at delivery the full rental charge to COMPANY in advance b) Any taxes, duties and other expenses related to the vehicle c) Any fines, penalties, court costs and other expenses imposed on the COMPANY due to the illegal use of vehicle by renter d)Any amounts replacing or repairing of destroyed tyres or wheels or any sums tor restoring damages underneath of the vehicle.
MISCELLANEOUS
a) All additional authorized drivers are jointly and severally liable the renter under this agreement b) Vehicle is always property of. Any and all disputes which may arise between and renter will be subject to the exclusive jurisdiction of the courts in Greece. |
